All services are subject to a written project agreement signed by both parties before work begins. Website content describing services is for informational purposes only and does not constitute a binding offer or guarantee of availability.
Free on-site estimates are provided without obligation. Written estimates are based on information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated.
Final project pricing is set forth in your signed written contract. We do not begin work without a signed agreement. If site conditions discovered during the project materially differ from what was assessed during the estimate - such as buried obstructions, soil conditions, or existing structural issues not visible at the time of estimate - we will notify you and obtain your written approval before proceeding with any scope or cost change.
Oral or informal discussions about pricing do not constitute a binding quote. Only written, signed agreements are binding.
Project start dates are scheduled upon execution of a written contract. We make reasonable efforts to meet the agreed start date. We are not liable for delays caused by weather, permit processing times, material supply issues, or other conditions outside our control.
If you need to reschedule or cancel your project, please notify us in writing as early as possible. Cancellations made after materials have been ordered or work has begun may be subject to charges for materials procured and work completed to the cancellation date, as specified in your written contract.
We reserve the right to reschedule work due to unsafe weather conditions, including heavy rain, wind, or extreme heat. We will notify you as soon as possible in those situations.
Payment terms are specified in your written project contract. In general, we may require a deposit prior to scheduling and the remainder upon completion of the project. Payment is due upon completion unless otherwise agreed in writing.
Accepted payment methods are specified in your contract. Late payments may be subject to interest charges as allowed under California law. If it becomes necessary to pursue collection of unpaid amounts, you agree to pay all reasonable collection costs and attorney fees incurred.
Under California law, we may have the right to place a mechanic's lien on your property if payment for services rendered is not received. We hope that this never becomes necessary and we encourage open communication if you have any concerns about billing.
Before work begins, you are responsible for:
Where required by the City of Petaluma or applicable local jurisdiction, we will apply for and obtain the necessary building permits as part of your project. Permit fees, if applicable, are either included in your written estimate or billed at cost as a pass-through. You agree to cooperate with any required inspections or documentation requests from the relevant permit authority.
We warrant our workmanship against defects in installation for a period specified in your written project contract. Manufacturer warranties on materials, if any, are passed through to you as the property owner.
Our workmanship warranty does not cover damage caused by: acts of nature (wind, flooding, fire, earthquake), vehicle impact, vandalism, improper use, failure to perform recommended maintenance, soil movement not attributable to installation error, or unauthorized modifications to the fence after installation.
EXCEPT AS EXPRESSLY STATED IN YOUR WRITTEN CONTRACT, ALL SERVICES AND MATERIALS ARE PROVIDED "AS IS" WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
To the fullest extent permitted by California law, Advanced Petaluma Fence's total liability to you for any claim arising out of or related to our services or these terms shall not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages of any kind, including loss of use, loss of profits, or property damage beyond the scope of our direct work, even if we have been advised of the possibility of such damages.
We want to resolve any concerns or disputes directly and promptly. If you have a problem with our work, please contact us first at info@petalumafence.com or (707) 222-6844. We commit to responding within 2 business days.
If a dispute cannot be resolved informally, both parties agree to attempt mediation in Petaluma, CA before initiating any legal proceeding. If mediation is unsuccessful, disputes shall be resolved in the appropriate court of competent jurisdiction in Sonoma County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising out of or related to these terms shall be brought exclusively in the courts located in Sonoma County, California.
